What is Customs tariff classification and why is it important?

Customs tariff classification is the process of assigning a specific numerical code to traded goods. It aims to identify items that are imported and exported. It is important that companies classify goods correctly because doing so will accurately determine what taxes, duties and other contributions must be paid. The consequences of incorrect classification of goods may include overpayment or underpayment of duties, penalty and interest charges, heightened scrutiny, shipping delays, as well as the possibility of full Customs audits.

What are the main differences between the USMCA and the NAFTA?
-
The United States-Mexico-Canada Free Trade Agreement (USMCA) replaced NAFTA on July 1, 2020. The main differences between the two treaties are that:
- Certification of origin may be made by the importer of record, exporter, or manufacturer.
- A “Certification Statement” replaces the NAFTA Certification Form.
- The specific Rules of Origin have been modified for many products and industry sectors (Automotive, Chemical, Textiles, and Plastics).
- A new de minimis rule increases the amount of non-originating content from 7% to 10%.

What duties and taxes are payable on imports?

Unless they are exempt, all commercial goods that enter the commerce of the United States from outside of the national borders are subject to legally prescribed Customs duties and taxes. In addition to such levies, some imported items are also assessed for other required payments and fees. These may include charges such as excise duties, and taxes, as well as countervailing and anti-dumping duties.
